My 140 was denied based on the filing was Eb2 but job requirement only fits in eb3.
I filed my appeal with a new 140 on the same labor in Eb3, and in my Motion to Reopen specified to consider my old application in eb3 but if they will not to atleast consider my new application. This was an year back and I have filed premium, my new 140 was approved in 3 days, old one went AAO, but we withdrew the old one.
Talk to a good attorney, I consulted Aron Finkelstein in Murthy law firm. They were nominal and excellent customer support.

It looks like this was an inadvertent statement of the President's plans before it was formally announced by the Justice Department. My PD is Feb 20, 2006. I fall into EB-3 ROW and it seems like my PD will be current in May 2008. I filed my I-485 in Aug 2007 and have had my EAD and AP approved. I got married in Sept 2007 and my spouse came here on H-4 after our marriage and we both have valid visas respectively H1 and H4. She can't file I-485 to adjust status until May due to PD not being current. We would like to handle the task of filing I-485/EAD/AP for her ourselves without paying our attorney. I do have all documents my attorney filed for myself so I plan to mimic them when we file my spouse's papers.
What I do not know is, if there's anything we need to do for her to represent herself. Do i need to let my attorney know that we are filing I-485 on our own? Does my attorney need to do anything?
I am thinking that her application should be easier than mine as she is simply a dependent.
Do I need to sign anything or fill out any form as the primary applicant or the approach is simple.... as long as she can prove that she is my spouse, (I have a I-485 pending) and PD is current she can do AOS?
Do all forms for I-485, EAD and AP need to be mailed together? Is information about her background/work/school diploma needed?
Has anybody been in this situtation or similar and is there a checklist of things to do?
Thank you in advance for any help or advice.

In OHIO I have successfully renewed my DL for 4 full years solely on original I-485 receipt.
On H1 they still give 1 year extensions.
Try doing the same in your state.

I understand the 180 days rule after filing 485. what if the eb3(140 approved) based 485 has been pending for 180 days, and a newly approved eb2 140 has just been ported to the pending 485.
Yes, 180 days rules applies to your 485 receipt date on your receipt notice.
Is there a rule that the 180 days started over again after porting, since it's a new 140, which implys the applicant intends to work for the 140 position for a period of time.
There is no rule that makes the "180 days" clock to restart.
What are the risks if the applicant changes the job right after eb2 140 gets approved, and changed the underlining 140 of the pending 485 from eb3 to the newly approved eb2.
There are no risks as long as your eb2 140 is approved, you have crossed 180 days count. Additionally, AFTER you have received a confirmation from USCIS that your eb3 to eb2 porting is successful and the new approved 140 is the underlying petition to support your 485

My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.
e-file your i-140, then you have 7 business days to send in your supporting documents (receipt notice is generated immediately from your printer). I-485 can be filed before August 17

I'm going to Vancouver for H1B stamping next week along with my spouse. My understanding is that $150 is the application fee but I'm not sure if it is $150 for entire application (H1 + H4) or is it $300 ($150 for myself and $150 for my wife).
Can someone please clarify? and if I need to have separate Scotia bank receipts for myself and my wife?

India has expressed its concern to the Chinese government over Beijing issuing visas on a separate sheet of paper to Indian nationals from Jammu and Kashmir instead of stamping them in their passports. Ministry of External Affairs (MEA), India strongly believes this, as a well-thought-out strategy to question the status of its state Jammu and Kashmir. It has been issuing visas stapled to passports to people from Arunachal Pradesh who have traveled to China since 2007.
MEA spokesperson Vishnu Prakash says We have conveyed our concern to the Chinese government in this regard. It is our considered view and position that there should be no discrimination against visa applicants of Indian nationality on grounds of domicile or ethnicity.
Its not clear when the Chinese started issuing visas on a separate sheet of paper to Indian travelers of Kashmir. The matter came to light when immigration authorities at New Delhi International Airport, India turned away Kashmiris carrying the standalone visas, assuming they were fakes. The Chinese embassy however issued letters confirming that it had issued valid visas. The matter was then brought to MEAs notice, prompting it to take up the issue with Beijing. Immigration authorities have been directed to treat the standalone visas as invalid.
This is just to brought some Immigration development in other parts of world. We strongly belief that both the Asian neighbors will resolve such issues amicably soon.

"Senate leadership is comfortable with a proposal to solve retrogression for Schedule A occupation -- registered nurses and physical therapists. It was through grassroots advocacy that we were able to explain to the Senate leadership just how important this issue is. Thank you to everyone who made an effort.
We now must turn our efforts toward the House."

Sorry to hear about your situation. You are out of status the minuet you lost your job and the 180 days clock has already started ticking i.e. out of status for more then 180 days and still in the country may result in 5 yr entry ban.
I don't want to scare you but just sharing the law details.
Now you best course of action would be to get a job ASAP and get your H1 transferred. For this process immigration will ask for your last pay stub and if there is a big gap then they might reject your visa but again it is hard to say anything as it totally depends upon the officer.
Also, hire a good attorney if you can.
Staying in the US after losing a job on H1 is a gray area, especially when you have a valid i-94 hence getting a good attorney is very important.
Also, you might want to look at student visa or visitor visa to maintain your legal status.
Good luck
Do you have any idea about the other legal options in terms of immigration i might have.?

Two questions for the experts...
I am on J1 visa and have received a home residency requirement waiver. Do the experts here know if I can apply for a J1 visa extension (after receiving the waiver)? I read somewhere that it may not be possible to do so.
Also, are there are any foreign travel restriction on a J-1 visa?
Thanks
Getting a waiver implies that you want to change your status. So renewal may not be a good idea. I would talk to a lawyer about the implications.

Interesting article regarding how a Utah congressional primary could affect the Senate House conference on CIR.
http://www.opinionjournal.com/diary/?id=110008446
It looks like the anti-immigrant groups are pumping money into the campaign of a Tancredo clone in an attempt to unseat a pro-immigrant Republican Congressman.
Mr. Throckmorton benefited from $80,000 in radio and billboard ads donated by anti-immigration groups upset by Mr. Cannon's strong support of a guest-worker approach.
The anti-immigration groups are probably counting on a loss by the incumbent congressman to help convince other House Republicans that opposing S 2611 would help their reelection chances
A loss by Mr. Cannon would have profound political consequences. Conservative activist Grover Norquist has called the Utah congressman "the president's strongest ally in maintaining a pro-immigrant GOP." Mr. Cannon has long been one of the few members to point out the genuine need the U.S. economy has for new workers. He has publicly chided some of his colleagues for "demagoguing the immigration issue--some to raise money, some for attention." He has pointed out that some anti-immigration groups have ties to environmental and population-control extremists.
If they succeed, CIR would probably go nowhere this year, or would get most of the pro-immigrant sections stripped out in conference. From the looks of it, these groups are pulling out all the stops. Just goes to show what we are up against.

If one has already recieved their Green Card and been working with the same employer who sponsered their Green card, for 6 months, can they then leave the employer and take a break for another 6 months?
Is it necessary to be working always if one has recieved an employment based Green Card?
