Got an RFE request on a I485 that I think is a huge problem.
I spent a year in the USA in 97-98 on J1 student exchange Visa.
I went back to Russia, and finished the last year of high school there.
Then in '99 I came back to the USA on an F1 visa, did a four year college. After that I have been continuously employed on H1b, filed for green card in 2007.
RFE is requesting information about Section 212 of Immigration and Nationality Act.
How big of a trouble am I in?

We are closing our physical office and going to have a virtual with PO box,. Please let me know how it will impact current and future H1s, Greencard filings and L1s and Business visas.

To buttress IV strategy any tasks for members during the holiday season..I understand we dont dicuss any strategies in open Forums..but to support your strategies during the holiday season?..people will have a little more free time..so we can involve in writing / meeting senators!??..
There is only lill time before the senate opens again!

2- Take active role in your state chapter. If your state chapter is not active, then make it active yourself. Contact other members from your state through the state chapter thread and start working on action items

You dont have to be employed by the employer for 180 days. All you need is 485 pending for 180 days. So in the letter you can mention that 485 had been pending for more than 180 days.
The only catch is if USCIS question about your "intention" at the time of filing 485. (Since you didnt work for the company after 485, and now specifically says dont intent to..).
At the time of filing 485 you should have proper intention to join the original employer.
Maybe somebody else who went through similar experience can help u.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

It depends on how many cases that will be pending approval on October after the surge of applications this July and August.
I think it wouldn't be current for some countries specifically India and China.

Our lawyer had posted our application on July 2nd and we had our fingerprinting scheduled for 21st august which was completed.
I checked my status on the USCIS site for the very first time today. And it says. "On July 30, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case" . Can anyone kindly explain me what this means ( how July 30th and what mail are they talking about ?we never received any! ) ...

I agree that option B is the correct choice. They are looking for you to have a stable residency, so having it established as the application time nears makes the most sense. Still, I would consult with an expert or an attorney if you have the opportunity.

If you graduated 1 year ago and was no longer a student in this last year, and did not apply for OPT before graduation, then you are already out of status - your F1 status ceased when you graduated. Moreover, your I-94 most likely said D/S. So the I-94 covered your stay only during the time you maintained F1 status. So you have been accruing illegal presence time. 6 month of illegal presence would trigger 3 year ban on reentering US; and 1 year or more would trigger a 10 year ban.
The prudent thing for you to do is to go back to your home country, and come back with a proper VISA.

Hope you don't mind me messing with this a bit, but sometimes it's easier to do it in photoshop than to explain with words what could be different. View the attached thumbnail (click on it for fullversion) to see how a slight change in the position of the elements could affect the photograph (the "ZING" as Lecter calls it ;)).
You did, however, pick a good time of day for your photo. Too early and the plane might be even darker with no detail, and too late and the moon would have to be overexposed if you wanted the rest of the picture to look like it does now.

No. He got the new I797 recently and does'nt have VISA.
Thats what probably triggered the 221(g).
They have to verify documents on his visa.
IV had few posts on this earlier in 2007, search for that. You can find some good information.

While parents apply for a tourist visa, in DS-156 where it says "who will pay for the trip", if they mention "self" do we still have to send an Affidavit of Support.
Secondly, do they have to show sufficient cash in their bank account for the trip or will investment proof be ok.
Thirdly, our extended visa is expiring 28thApr'07 & we've applied for renewal in feb'07. We have n't received the receipt yet. Will our current visa copy be sufficient ?
